General Terms and Conditions (T&C)

§1 Scope

These Terms & Conditions apply to all business relationships between DriveLux Cars GmbH (hereinafter "Seller") and its customers in relation to the sale of vehicles and machinery.

Deviating conditions of the customer will only be recognised if the Seller expressly agrees to them in writing.

§2 Subject Matter

The Seller trades in:

• Passenger vehicles (cars)
• Commercial vehicles
• Construction and heavy machinery

The vehicles shown on the website do not constitute a legally binding offer but serve for information purposes only. A purchase contract is concluded exclusively by written confirmation or by signing a purchase agreement.

§3 Prices and Payment Terms

All prices are in Euro (€). Whether prices include or exclude VAT is stated explicitly in the respective offer. Payment is made by individual arrangement (e.g. bank transfer, cash on delivery).

§4 Vehicle Condition and Information

All information about vehicles and machinery (e.g. year of manufacture, mileage, equipment, technical data) is provided to the best of our knowledge. Errors, prior sale and technical changes are reserved. The buyer is obliged to inspect or have the vehicle inspected independently before concluding the contract.

§5 Warranty

For consumers, the statutory warranty rights under German law apply. When selling to businesses, the warranty may be contractually limited or excluded where permitted by law.

§6 Liability

The Seller is liable without limitation for intent, gross negligence and injury to life, body or health. Otherwise, liability is limited to the typical, foreseeable damage.

§7 Retention of Title

The vehicle or machine remains the property of the Seller until full payment has been received.

§8 Jurisdiction and Applicable Law

The law of the Federal Republic of Germany applies. The place of jurisdiction is – to the extent permitted by law – the Seller's registered address in 12353 Berlin.

§9 Severability Clause

Should any provision of these Terms & Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
